By accessing or using Spriggan Assistant's AI receptionist services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.
These Terms constitute a legally binding agreement between you and Spriggan Assistant. Please read them carefully before using our Services.
2. Description of Service
Spriggan Assistant provides AI-powered receptionist services to retail businesses. Our Services include:
- Automated phone answering and call handling
- Store hours, location, and general information responses
- Real-time inventory and stock availability lookups
- Order status tracking and updates
- Appointment and service booking
- SMS/text message notifications and follow-ups
- PCI-compliant payment processing
- Return and exchange policy communication
- Customer loyalty and rewards lookups
- After-hours message capture
- Outbound notifications (sale alerts, pickup ready, back-in-stock)
Our Services are provided to retail businesses who, in turn, use them to communicate with their customers. As a customer, you may interact with our Services through your preferred retail store.
3. SMS/Text Messaging Terms
By providing your mobile phone number and opting in to receive text messages, you agree to the following SMS terms:
Message Frequency
Message frequency varies based on your retail interactions. You may receive messages for order updates, pickup notifications, promotional offers, back-in-stock alerts, and other retail-related communications. Typically, you may receive 1-10 messages per month, but this may vary.
Message and Data Rates
Message and data rates may apply. Check with your mobile carrier for details about your messaging plan. Spriggan Assistant is not responsible for any charges from your mobile carrier.
Opt-Out Instructions
You can opt out of SMS messages at any time by texting STOP to any message you receive from us. After you opt out, you will receive a final confirmation message, and no further messages will be sent unless you opt in again.

Supported Carriers
Our SMS services are supported by major U.S. carriers including AT&T, Verizon, T-Mobile, Sprint, and others. Carrier participation may vary.
Consent
By opting in to receive SMS messages, you consent to receive autodialed and prerecorded messages from Spriggan Assistant or retailers using our platform. Consent is not a condition of purchase or service from the retail business.
4. PCI DSS Compliance and Payment Processing
Spriggan Assistant operates in compliance with the Payment Card Industry Data Security Standard (PCI DSS) for all payment processing activities.
- All payment card data is tokenized and encrypted end-to-end
- Raw card numbers are never stored on our servers
- We maintain PCI DSS compliance through regular audits and assessments
- Payment processing is handled by PCI-certified payment processors
Retail businesses using our payment processing features remain responsible for their own PCI DSS compliance obligations. We provide the tools and infrastructure to facilitate compliant payment handling.
5. Call Recording and Consent
Our Services may record and transcribe phone calls for quality assurance, training, and service improvement purposes. By using our Services, you acknowledge and consent to the recording of calls.
All callers are notified at the beginning of each call that the conversation may be recorded. If you do not consent to recording, you may request to speak with a staff member directly.
6. User Responsibilities
When using our Services, you agree to:
- Provide accurate and complete information
- Update your information if it changes
- Use the Services only for lawful purposes
- Not attempt to interfere with or disrupt the Services
- Not impersonate another person or entity
- Comply with all applicable laws and regulations

No Professional Advice: Our Services are administrative in nature and do not constitute professional retail, legal, or financial advice.
"As Is" Service: Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Service Availability: We do not guarantee that our Services will be uninterrupted, timely, secure, or error-free.
Inventory Accuracy: While we strive to provide accurate inventory information, real-time availability may vary. We are not liable for discrepancies between reported and actual stock levels.
10. Limitation of Liability
To the fullest extent permitted by law, Spriggan Assistant shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from:
- Your use or inability to use our Services
- Any unauthorized access to or alteration of your data
- Any interruption or cessation of our Services
- Any errors or omissions in our Services
11. Indemnification
You agree to indemnify, defend, and hold harmless Spriggan Assistant and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of our Services or your violation of these Terms.

We may terminate or suspend your access to our Services at any time, without prior notice or liability, for any reason, including if you breach these Terms.
